노동자의 힘으로 고용허가제 사업장 변경지침 폐지하자!

쓰레기 같은 고용노동부의 지침
고용노동부가 8월 1일부터 실시하고 있는 ‘사업장 변경 지침’에 대한 규탄의 목소리가 갈수록 커지고 있다. 이 지침은 이주노동자에게 이전처럼 구직 업체 명단을 주지 않고, 대신에 사업주에게 이주노동자 명단을 주어서 사업주가 선택을 하게 한다. 이주노동자는 그냥 사업주의 전화만 기다려야 한다. 원래 이주노동자는 휴업이나 폐업, 폭행, 임금체불, 성희롱 등을 제외하고는 사업주의 동의를 얻어야 해서 사업장 변경이 극히 힘들었다. 물론 그런 사유가 있어도 이주노동자가 입증을 해야 하기 때문에 어려운 건 마찬가지였다.
그런데 고용노동부의 지침은 제한된 범위의 사업장 선택마저 아예 금지하는 ‘쓰레기’ 같은 지침이다. 노예처럼 일하고 아무리 힘들어도 참고 견디며 사업장은 절대 바꾸지 말라는 것이다. 완전히 인종차별적이고 이주노동자를 억압하는 지침이다.

이주노동자의 저항
이주노동자들은 이 지침에 대해 크게 분노했다. 즉각 전국의 이주 관련 단체들은 ‘사업장 변경 지침 철회 비대위’를 결성해서 행동에 돌입했다. 8월 19일에는 고용허가제 시행 8년에 즈음하여 “고용허가제 폐지! 사업장 이동의 자유보장! 노동기본권 쟁취! 이주노동자 투쟁의 날” 집회를 서울·아산·대구·부산 등지에서 개최했다. 9월 23일에는 ‘이주노동자 투쟁의 날 집회’를 서울역에서 전국 집중으로 개최했다.
이러한 흐름에서 주목할 점은 젊은 세대의 이주노동자들이 새롭게 저항에 나서고 있다는 사실이다. 시종일관 활기차게, 다른 이주노동자들의 발언에 적극적으로 공감하고 열정적으로 구호를 외치고 행진했다. 10월 28일에 열린 ‘사업장 변경지침 피해사례 증언대회’에서도 이주노동자들은 분노의 목소리를 내며 즉각적인 지침 폐지를 주장했다. 짧은 기간에 4천 명이 넘는 서명이 모이기도 했다.

주체를 조직하고 연대를 확대하자
이러한 이주노동자들의 투쟁은 더욱 확대되어야 한다. 고용노동부는 이주노동자들의 투쟁에 놀라서 지침을 약간 바꿨지만 여전히 이주노동자들의 목소리를 외면하고 있다. 아직 이주노동자의 조직된 대오와 힘이 그만큼 커지지는 않은 것이다. 무엇보다 이주노동자들 스스로가 주변의 이주노동자들, 같은 나라 이주노동자들에게 이 문제를 알리고 이주노조(MTU)로 조직하여 조직화된 힘을 키워야 한다. 그리고 그 과정에서 활동가들을 발굴하고 강한 리더십을 형성해야 한다.
이 투쟁에서 한국의 운동단체들도 할 역할이 많다. 사회진보연대는 이주노동자들의 투쟁과 조직화에 적극적인 지원과 연대를 아끼지 않을 것이다. 노동조합·정당·사회단체 등 한국의 제 운동 단체들은 이주노동자들과 더욱 연대를 강화해야 한다.
한국의 70만 이주노동자들이 단결한다면, 이주노동자와 한국노동자들이 함께 투쟁한다면 힘은 어마어마하게 커질 것이다. 사장이 시키는 대로 기계처럼 일만 하는 존재가 아니라, 진정한 노동자이자 인간으로서 이주노동자의 사회적 권리를 쟁취하기 위해 함께 투쟁하자!


Abolish the new EPS Rule on Workplace Changes through the Workers’ Unity

The new EPS Rule is Garbage
Voices calling out in protest against the new EPS rule on workplace changes are growing louder and louder everyday. Under this rule migrant workers who are looking for a new job no longer receive a list of workplaces with job openings. Instead, employers receive a list of unemployed migrant workers. Migrant workers can then do nothing more than wait for a prospective employer to call. Even before the new rule was implement, changing workplaces was already hard for migrant workers. This is because the EPS law requires them to obtain permission from their employers to change workplaces except in cases where the workplace closes down temporarily or permanently, or where there are severe rights violations such as violence, sexual harrassment or non-payment of wages. Even in such cases, the burden is on migrant workers to prove that such violations exist, a very difficult task. As if these obstacles were not enough, the new EPS rule completely takes away the little flexibility migrant workers had to choose where they worked.
The message of the new rule is that migrant workers should work like slaves, enduring all conditions no matter how bad, rather than even thinking about changing to a new workplace. In other words it is a garbage rule that is racist and oppressive.

Migrant Workers Protest
But migrant workers are not staying silent in the face of this injustice. As soon as the law was past, migrant rights organizations around the country formed a “Committee to Repeal the Workplace Change Rule” and began to protest. On August 19th, in timing with the 8th anniversary of the introduction of the EPS, migrant workers gathered for a Migrant Workers’ Day of Action in Seoul, Asan and Busan. They held rallies calling for the abolition of the EPS, guarantee of the right to freely change workplaces and basic labor rights. On September 23 a national migrant workers’ rally was held at Seoul station, with 1,000 migrant workers and supporters attending.
The activities sparked by the new EPS rule have been marked by the strong participation of a new generation of young migrant workers. The constant energy of these young people, demonstrated in their moving speeches and ardent chanting, has given the migrant workers’ movement a new life. On October 28, these workers expressed their rage and demanded repeal of the new rule at a migrant workers’ Speak Out event. They have also collected over 4,000 signatures on a petition against the new rule in just the last few weeks.

Its Time for Solidarity and Organizing
There is a great amount of energy already, but the struggle against the new EPS rule must grow stronger. The Ministry of Employment and Labor has been shocked enough by the protests to revise the new rule slightly, but it is still ignoring the central demand for the rule’s repeal. The struggle must grow in numbers and power if we are going to have our voices heard.
To gain strength the most important thing is for migrant workers to organize their friends and fellow nationals to join the Migrants Trade Union(MTU) and become active in the struggle. In this process, it is necessary to find and develop new activists and leaders. Korean organizations also have a role to play as well. We, People’s Solidarity for Social Progress, pledge to do all we can support migrant workers’ organizing and protest. It is important that other Korean organizations, unions and political parties also strengthen their solidarity and support for the migrant workers struggle.

If all 700,000 migrant workers in South Korea unite - if Korean workers also join forces with them – we will become unstoppable. We will, then, cease to be machines, existing simply to be used by employers at will, and become a dignified working class and dignified human begins. Let’s build our struggle together!
